Stop punishing possession of condoms!

Tell your Assembly Member to support the No Condoms as Evidence of Prostitution Bill (A.3856, S.1289)

This bill would stop police and prosecutors from using possession of condoms as evidence that a person engaged—or intended to engage—in prostitution.  Currently, police and courts can—and do—use the fact that a person has condoms to prove that they are engaging in criminal activity. The resulting police practice of confiscating condoms during arrests for prostitution-related offenses is preventing people from protecting themselves.

Dear [ Decision Maker ] ,

I urge you to support the No Condoms as Evidence of Prostitution Bill. This bill would eliminate the fear that carrying a condom could be used against you by police or in a court of law. Currently, police and courts can - and do - use the fact that a person has condoms as evidence of criminal activity.

This practice deters people from acting responsibly and carrying protection. People should be encouraged to carry condoms, not punished for doing so. The New York State Department of Health promotes condom usage and availability for all people. Yet police and prosecutor practices are discouraging people from carrying condoms for fear of being targeted for arrest and prosecution.

Sound public health and fiscal policy demand that we eliminate this deterrent to condom use. Please tell bring the No Condoms as Evidence of Prostitution bill (A.3856, S.1289) to the floor for a vote.
